WorkVans Terms of Use for Dealers

Welcome to WorkVans, a marketplace connecting buyers and sellers of commercial vehicles. These Terms of Use apply to dealers who wish to advertise vehicles on the WorkVans platform . By creating an account and using the Platform, you agree to comply with these Terms. If you do not agree to these Terms, you must not use the Platform.
1. Eligibility and Dealer Account
1.1. Eligibility: You must be a registered business entity or individual legally permitted to sell vehicles under the laws of England and Wales.
1.2. Account Creation: Dealers are required to create an account and provide accurate, up-to-date information, including business name, contact details, and any applicable licenses.
1.3. Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and all activity on your account. Notify us immediately of unauthorised access.
2. Use of the Platform
2.1. Permitted Use: You may use the Platform to list, advertise, and sell vehicles that meet our listing guidelines.

3. Listings and Advertising
3.1. Accuracy: All vehicle listings must be accurate and include complete details such as make, model, year, mileage, price, and any defects or modifications.
3.2. Photos and Media: You must upload clear and accurate images. Stock images or misleading visuals are prohibited.
3.3. Pricing: All prices must include VAT (if applicable) and other charges clearly disclosed.
3.4. Removal of Listings: WorkVans reserves the right to remove any listing that violates these Terms or is flagged as inappropriate by users.
4. Fees and Payments
4.1. Subscription Fees: Dealers must pay the applicable subscription fee to access advertising features on the Platform. Fees are non-refundable unless otherwise specified.
4.2. Transaction Fees: If applicable, additional fees may apply for services such as featured listings or priority placement.
4.3. Failure to Pay: Late or failed payments may result in suspension or termination of your account.
5. Dealer Conduct
5.1. Professional Behaviour: Dealers must communicate with potential buyers in a professional manner and avoid harassment or discriminatory behaviour.
5.2. Disputes: Any disputes between Dealers and buyers must be handled directly. WorkVans is not responsible for mediating disputes.
6. Intellectual Property
6.1. Dealer Content: By uploading content (e.g., photos, descriptions), you grant WorkVans a non-exclusive, royalty-free license to use, reproduce, and display your content on the Platform.
6.2. Platform Rights: All Platform content, branding, and design remain the property of WorkVans. You may not use our trademarks without written permission.
7. Termination
7.1. Voluntary Termination: You may terminate your account at any time by contacting WorkVans.
7.2. Termination by WorkVans: We reserve the right to suspend or terminate accounts that violate these Terms, engage in prohibited activities, or fail to pay fees.
8. Liability and Indemnification
8.1. Liability Disclaimer: WorkVans provides the Platform “ is” and does not guarantee the accuracy of buyer or seller information, or the success of sales.
8.2. Indemnity: Dealers agree to indemnify and hold WorkVans harmless from any claims, damages, or losses arising from your use of the Platform or breach of these Terms.
9. Data Protection and Privacy
9.1. Dealer Information: WorkVans processes your personal data in accordance with our Privacy Policy.
9.2. Buyer Data: You must protect any buyer data obtained through the Platform and comply with data protection laws applicable in England and Wales, including the UK General Data Protection Regulation (UK GDPR).
10. Dispute Resolution
10.1. Governing Law: These Terms, and any disputes or claims arising out of or in connection with them, are governed by the laws of England and Wales.
10.2. Jurisdiction: The courts of England and Wales will have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms.
11. Modifications to Terms
WorkVans reserves the right to update these Terms at any time. Dealers will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised Terms.
